LEGAL PROVISIONS

 

The person who uploads the material necessary for the application grants mdw permission to use the submitted material (e.g. concept, video) in its original, edited or otherwise modified version (in particular in connection with other works and performances) with regard to all copyrights and rights derived from copyrights (in particular ancillary copyrights of the performers and producers of audio and video recordings). This permission is valid for an unlimited period of time and is irrevocable, spatially unrestricted and factually limited to the context of the competition in question.

Should third parties assert copyright or similar claims against mdw as a result of the participant's participation in the competition, the participant shall indemnify and hold mdw harmless.

Any rights to be asserted by collecting societies remain unaffected.

 

Data protection information in accordance with Art 13 GDPR – Let’s get digital! Competition for hybrid concerting

The mdw – University of Music and Performing Arts Vienna, places great importance on the protection of data pertaining to your person and processes such data exclusively in conformance with applicable data protection laws.

Purpose and Legal Basis

The personal data you provide for the registration to the competition will be processed for the purpose of processing your registration and carrying out the competition.

The processing is carried out on the basis of the contractual obligations and necessities resulting from participation in the competition, in accordance with Art 6 Sec 1 (b) GDPR or on the basis of public interests in accordance with Art 6 Sec 1 (e) GDPR in connection with §§ 1-3 UG or, insofar as the mdw does not act in fulfilment of its responsibilities under public law, on the basis of the legitimate interest of the persons responsible in accordance with Art 6 Sec 1 (f) GDPR.

The provision of your data is absolutely necessary to enable you to participate in the competition and to conduct the competition themselves. Therefore, participation is not possible without disclosure of the data.

Recipients of Transmitted Data

The data will be processed internally by the administrative staff and teaching staff organising the  competition and will only be passed on internally or to third parties if this is necessary for the purpose of processing the contract or if it is in the public interest according to Art 6 Sec 1 (e) GDPR in connection with §§ 1-3 of the Austrian Universities Act (UG) or, insofar as the mdw does not act in fulfilment of its responsibilities under public law, if it is in the legitimate interest of the persons responsible according to Art 6 Sec 1 (f) GDPR, or if you have given your prior consent.

Deletion of Data

The data will be stored by us for the duration of the competition and beyond that for the duration of any legal claims that may exist or on the basis of legal obligations to the extent of an expected 10 years.

Data Security

We use appropriate technical and organisational security measures to process and store your data safely, whereby our security measures are in accordance with the respective best available technology at any time. Furthermore, your data can only be accessed by those individuals who need it in order to fulfil their work responsibilities.

Your Rights

As a party affected by this data processing you are entitled within the framework of Art 15 to 21 GDPR in relation to the mdw to the r right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object.

Furthermore, you have the option of submitting a complaint to the Austrian Data Protection Authority. (In Austria: Österreichische Datenschutzbehörde, dsb@dsb.gv.at).
